MF Collective Terms & Conditions

MF Collective is a solo creative contracting operation run by Megan Foster, based in Christchurch, New Zealand. All work is carried out by me personally unless we agree otherwise in writing.

These terms cover how I work, what you get, and what happens when things change. If anything here isn't clear, ask me before you accept a quote. I'd rather have the conversation upfront.

1. Accepting these terms

By accepting a quote or paying an invoice from MF Collective, you agree to these terms.

Acceptance includes:

  • Confirming a quote by email, text, or in writing

  • Paying an invoice in full or in part

  • Asking me to begin work after receiving a quote

 

If you're accepting on behalf of a business or organisation, you're confirming you have the authority to do that.

2. Quotes and pricing
  • All quotes are valid for 30 days from the date issued.

  • Quotes are based on the brief given to me at the time. If the brief changes, the price may change too.

  • All prices are in New Zealand dollars and exclude GST unless stated otherwise.

  • Anything not listed in the quote isn't included in the quote.

3. Payment

Where the invoice or quote states that payment is required prior to commencement of work, no work begins until that payment has cleared into my account. This is not negotiable and it isn't personal. It's how I protect my time.

Payment terms vary depending on the client:

  • New clients and one-off projects: full payment upfront, before work starts.

  • Established clients and contracted organisations: payment on completion, due within 14 days of invoice date unless stated otherwise on the invoice.

  • Larger projects: a deposit is payable upfront with the balance due on completion. The split will be set out in your quote.

 

Payment is by bank transfer to the account listed on your invoice.

If an invoice goes unpaid past its due date, I may pause all work on your project and hold delivery of files until the account is settled. Any agreed deadlines are also paused.

Overdue invoices accrue interest at 2% per month, charged on the outstanding balance from the due date until the invoice is paid in full. Part months are charged pro rata.

Overdue accounts may be passed on for recovery, and any costs involved in doing that are added to what's owed.

4. Refunds

All work is non-refundable once payment has been made.

The moment you pay, I start work. Hours go into your project straight away, whether that's research, concepting, shooting, writing, or design. Those hours can't be returned, so neither can the money.

This includes situations where:

  • You change your mind about the project

  • Your circumstances change and you no longer need the work

  • You're not happy with the creative direction

  • The project is cancelled, postponed, or abandoned partway through

  • You decide to go with someone else

 

The only exception is where a refund has been agreed by me in writing.

If you're not happy with the direction of the work, that's what the revision rounds are for. Talk to me. I'd much rather work with you to get it right than have you sit with something you don't love.

5. Revisions

Two rounds of revisions are included with every project unless your quote says otherwise.

One round means one consolidated set of feedback. Please gather all comments from everyone involved and send them through together. Feedback that trickles in over several messages across several days counts as multiple rounds.

Once your included rounds are used, further changes are charged at my standard hourly rate. I'll always let you know before that clock starts.

Revisions cover refinement of the agreed direction. A complete change of direction, a new concept, or new deliverables is a new job and will be quoted separately.

6. Files and delivery

You receive your relevant final files once the job is complete and paid in full.

  • Files are supplied digitally, in the formats suited to your project. That's usually print-ready PDF, JPG, PNG, and vector formats where relevant.

  • Unused concepts, rejected options, and drafts remain my property and are not supplied.

  • Please store your files somewhere safe. I archive work where I can, but I don't guarantee to hold copies indefinitely. Re-supplying archived files may incur a small fee.

 
7. AI design recreation

If you come to me with a design generated by an AI tool and you want it recreated as a proper, usable file, that is charged at $80 + GST on top of the standard design fee.

AI-generated images aren't built for real world use. They can't be scaled cleanly, printed properly, separated into colours, or adapted across formats. Recreating one means rebuilding it from scratch as a true vector file, and that's a separate piece of work.

8. Ownership and copyright

Once your invoice is paid in full, ownership of the final approved design transfers to you for the agreed use.

Until full payment is received, all work remains my property and may not be used, published, printed, or shared.

The following remain mine:

  • Unused and rejected concepts

  • Working files and source files, unless purchased separately

  • Any templates, processes, or systems I've developed

 

You may not resell, licence, or distribute the work as a standalone product, or claim it as your own original design work.

9. Portfolio and promotion

I reserve the right to feature work created for you in my portfolio, on my website, on social media, and in case studies, proposals, or award submissions.

If your project is confidential or under embargo, let me know before work starts and I'll keep it out of everything until you say otherwise.

10. Fonts, imagery, and licensing

Some projects need licensed fonts, stock imagery, video, or music.

  • Where a licence is needed, I'll flag the cost with you before purchasing.

  • Licence fees are charged on to you at cost and are non-refundable.

  • Licences are typically issued for a specific use. If you later want to use an asset in a different way, you may need to buy an extended licence.

  • If you supply me with images, logos, copy, or other material, you confirm you have the right to use it. I'm not responsible for any copyright claim arising from material you've supplied.

 
11. Printing and production

I don't print in-house. I can arrange printing through trusted suppliers, quoted separately, or supply you with print-ready files to take to your own printer.

  • You are responsible for checking and approving the final proof before anything goes to print or production.

  • Once you've approved a proof, any errors that make it through to print are not my responsibility, and reprint costs sit with you.

  • Colour on screen will never match printed colour exactly. Different printers, papers, and processes all shift the result.

 
12. Photography and videography
  • Shoot fees cover the agreed shoot time plus editing. Additional time on the day is charged at my hourly rate.

  • You receive a set number of edited images or an agreed final video. Raw, unedited files are not supplied.

  • Shoots cancelled or rescheduled with less than 48 hours notice are charged in full.

  • Outdoor shoots may need to be moved for weather. I'll always work with you to find a new date.

  • Usage rights are as set out in your quote. If you want to use imagery beyond that, let me know and we'll sort it.

 
13. Timeframes

Any timeframes I give you are estimates, not guarantees. They assume you get me what I need when I need it.

  • Delays in supplying content, information, feedback, or approvals will push your delivery date out.

  • If a project goes quiet on your end for more than 30 days, I may close it out. The work already done is still non-refundable, and restarting will be quoted as a new job.

  • If you need work turned around urgently or outside my usual hours, a rush fee may apply. I'll agree that with you first.

 
14. Changes to scope

If you want to add deliverables, change the brief significantly, or take the project in a new direction after work has started, that's new work and it gets quoted separately.

I'll never add a charge without telling you first. You'll always get the number before I start.

15. Retainers

Retainer agreements are set out in a separate proposal or agreement, and these terms sit alongside it.

  • Retainers are invoiced monthly in advance.

  • Monthly hour or deliverable allocations do not roll over into the following month.

  • Work beyond your allocation is charged at the agreed overage rate.

  • Notice periods and term length are as set out in your retainer agreement.

 
16. My responsibilities and yours

What I'll do:

  • Deliver the work described in your quote, to a professional standard

  • Keep you updated on progress and flag anything that might affect timing or cost

  • Treat your business information as confidential

 

What I need from you:

  • A clear brief and any content, assets, or information I need to get started

  • Timely feedback and approvals

  • One point of contact where possible, so feedback comes through consolidated

  • Payment on the terms agreed

 
17. Confidentiality

Anything you share with me that isn't public stays between us. That includes business plans, pricing, customer information, and anything else commercially sensitive. This applies during our work together and after it ends.

 
18. Liability

I take real care with every job, but there are limits to what I can be responsible for.

  • My total liability for any project is limited to the amount you've paid me for that project.

  • I'm not liable for indirect losses such as lost profit, lost business, lost data, or reputational damage.

  • I'm not responsible for the performance of third parties, including printers, suppliers, platforms, or hosting providers.

  • I'm not responsible for the commercial results of the work. I'll do everything I can to make it perform, but I can't guarantee sales, engagement, or enquiries.

 
19. Business to business

Where you engage me for business purposes, we both agree that the Consumer Guarantees Act 1993 does not apply, and that it is fair and reasonable for it not to apply.

 
20. Changes to these terms

I may update these terms from time to time. The version that applies to your project is the version current at the date you accept your quote.

 
21. Governing law

These terms are governed by the laws of New Zealand, and any dispute will be dealt with in the New Zealand courts.
